Terms of Service

These Terms describe how the Service works. The operating company, ABN, support email and governing State or Territory are not published yet. Complete them in src/lib/privacy.ts before a paying launch. Using the Service still binds you to the operative clauses below.

These Terms of Service (“Terms”) govern your access to and use of the Harbour website, calculator and practice workspace (the “Service”) operated by the operator of Harbour (entity not yet published) (“Harbour”, “we”, “us”).

By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Nature of the Service

Harbour is an indicative calculator and working-paper overlay designed to assist with understanding Super Guarantee due dates under current ATO Payday Super rules (rule pack 2026.2.0 and successors).

The Service:

  • is not payroll software
  • is not a SuperStream, STP or SGC lodgement tool
  • does not transmit any payments or data to the ATO or super funds
  • does not constitute tax, legal, financial or professional advice
  • is not provided by a registered tax agent or AFSL holder

All outputs are indicative working papers only. You must independently verify every calculation, date and amount before relying on them.

2. User responsibility

You remain solely responsible for:

  • all Super Guarantee calculations, payments, timing and filings
  • any Super Guarantee Charge, interest, penalties or other consequences
  • confirming outputs against official ATO guidance and your own records

You acknowledge that paying on the statutory due date via a clearing house is frequently late because of processing time.

3. Accounts and data

If you create an account or sign in:

  • You are responsible for safeguarding credentials and for all activity under your account.
  • Client names, ABNs, pay figures, bank balances and drafts you enter remain your data. We process them only to provide the Service.
  • Drafts and calculation snapshots are automatically purged after 90 days.
  • You may delete clients and drafts at any time.

We do not collect Tax File Numbers, payment card details or live payroll system credentials. Do not enter TFNs. See the Privacy Policy.

4. Acceptable use

You must not:

  • use the Service for any unlawful purpose
  • attempt to reverse-engineer, scrape or overload the Service
  • upload or enter TFNs or other prohibited sensitive information
  • represent Harbour outputs as certified, audited or official ATO determinations
  • use the Service if you are under 18 or lack capacity to enter binding contracts

5. Intellectual property

The Service, its design, code, methodology (rule pack 2026.2.0 and successors) and content are owned by us or our licensors. You may use outputs for your internal working papers. You may not copy, resell or commercialise the Service itself.

6. No warranty

The Service is provided “as is” and “as available”. To the maximum extent permitted by law we exclude all warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that calculations are error-free or that the Service will be uninterrupted.

7. Limitation of liability

To the maximum extent permitted by Australian law (including the Australian Consumer Law):

  • We are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or Super Guarantee Charge exposure arising from your use of the Service.
  • Our total aggregate liability arising out of or in connection with the Service is limited to AUD $100 or the amount you paid us (if any) in the 12 months preceding the claim, whichever is greater.
  • Nothing in these Terms excludes liability that cannot be excluded by law.

8. Indemnity

You indemnify us against all claims, losses and costs arising from your use of the Service, your data, or your breach of these Terms.

9. Termination

We may suspend or terminate your access at any time for breach or for operational reasons. You may stop using the Service at any time. Provisions that by nature should survive (liability, indemnity, IP) continue after termination.

10. Changes

We may update these Terms. Continued use after the effective date of changes constitutes acceptance. Material changes will be notified via the Service or email where practicable.

11. Governing law

These Terms are governed by the laws of Australia (specific State or Territory not yet published). Courts of that jurisdiction have exclusive jurisdiction, subject to any non-excludable consumer rights.
